Terms of Use
By completing the registration process for subscription/membership to the Australian Child and Adolescent Trauma, Loss and Grief Network website (website), you expressly agree to the terms and conditions set out below, to the ANU’s Disclaimer and Privacy notices (to view these notices see http://www.anu.edu.au/legal/content/copyright) and to any other terms, conditions, notices and disclaimers displayed elsewhere on the ANU’s sites (Terms of Use). ANU may amend the Terms of Use at any time.
Please read the Terms of Use carefully and if you do not agree with them, do not register as a friend of the network/member to the website.
- You agree that you are responsible and liable for all your activities while accessing and using the website, including all activities which occur under your username and password, whether authorised or otherwise.
- You agree that by providing your personal information to ANU, you consent to the collection, use and storage of your information by ANU in the manner described in its Privacy notice, and to the use of your personal information by ANU for the purposes set out on the website.
- You warrant that you have all rights, ownership and responsibility for all content posted to the website, including any trademark, copyright, patent or other intellectual property rights.
- You warrant that you will not post any material on the website that infringes the copyright of another person or entity, or that contains any libellous, defamatory, or unlawful matter, or matter that would be an invasion on the privacy of another person. Should you do so, you acknowledge that the ANU reserves the right to remove such materials from its server and terminate your subscription/membership to the website without warning.
- You warrant that you will not engage in commercial or revenue-generating activity from the website, including without limitation, posting any advertisements on the website. Should you do so, the ANU reserves the right to remove such materials from its server and terminate your subscription/membership to the website without warning.
- You warrant that any material you provide to the network to post on the website will comply with all applicable Commonwealth, State and Territory laws in force from time to time.
- You warrant that you will not tamper with the website, including by posting any materials or uploading programs that can be disruptive to online communication, including without limitation any viruses, worms or Trojan horses.
- You agree that in the event of a complaint being made by any person or entity regarding material that you post on the website, the ANU will refer that complaint on to you directly.
- ANU reserves the right to refuse to post and the right to remove any material, in whole or in part, or to ban a friend of the network/member, without notice and for any reason whatsoever in its absolute discretion.
- You agree that you will at all times defend, indemnify and hold harmless the ANU, its officers, employees and agents (in this clause referred to as ‘those indemnified’) from any and all demands, liabilities, losses, costs (including legal costs and expenses), claims, expenses, and damages on account of any and all manner of claims, demands, actions and proceedings that may be initiated against those indemnified by any person as a result of your breach of the Terms of Use, your use of the website, or on the grounds that information that you place on the website violates any copyright, proprietary right of any person or entity, state, territory or federal law, or contains any matter that is libellous, defamatory, scandalous or vexatious.
- You acknowledge that to the extent permitted by law, the website is made available to you as is, with no warranties whatsoever, including without limitation, the warranties of merchantability, fitness for a particular purpose, that the site will be available at all times, or will operate without error.
- You agree that to the extent permitted by law, the ANU will not be liable to you, whether in contract or in tort (including, without limitation, negligence) for lost profits or revenues, loss or interruption of use, lost or damaged data, failure of security, reports, documentation or security, or similar economic loss, or for any indirect, special, incidental, consequential or similar damages, arising out of or in connection with the use of the website, or for any claim made against you, your officers, employees or by any other person or entity.
If any part of the Terms of Use is held invalid, illegal or unenforceable, that part shall be severed and the remainder will continue to be valid and enforceable.
